In compliance with the provisions of the (EU) Regulation 2016/679 of the European Parliament and Council of the 27th April 2016 on the protection of natural persons in respect of the handling of personal data and the free movement of such data and repealing Directive 95/46/EC (hereafter GDPR) and other current regulations on the subject, CONSUM, S. COOP. V. (hereafter CONSUM), wishes to make website users aware of the policy regarding the handling and protection of personal data (hereafter Privacy Policy) of users of the website www.consum.es (hereafter site or website).

The visiting user is aware that access and use of the services and contents of the website are carried out under his/her sole responsibility.

CONSUM informs the user of the website that this privacy policy contains the aspects relating to the handling of personal data that CONSUM carries out as the entity responsible for this processing through the website.

MINORS OR LEGALLY INCOMPETENT PERSONS

Minors under the age of fourteen (14) years of age or incompetent persons may not carry out the personalised use of the CONSUM website or communicate their details through it, without the legal representation of their father, mother, guardian or other legal representative.  If the user is under the age of fourteen (14) years of age or incompetent, CONSUM informs the need for consent from their parents, guardians of legal representatives for the communication of their personal information to CONSUM, for which CONSUM asks them not to use the email service and not to register for any CONSUM service or competition without the consent of parents, guardians, or legal representatives, CONSUM not being liable under any circumstances for the acts of the minor or incompetent person.

 

ACCURACY AND TRUTHFULLNESS OF DATA OF A PERSONAL NATURE

Users who access the website are not obliged to provide personal information in order to browse it, therefore, any communication of data to this effect will be because the user has voluntarily chosen a personalised navigation or use of the website or any of its services.

CONSUM does not request or require through this website sensitive information or data from its users, or especially protected or special categories of data, understanding this to mean personal information which reveals the ethnic or racial origin, political opinions, religious or philosophical convictions, or trade union membership, and the handling of genetic data, biometric data directed towards unmistakeably identifying a natural person, data relating to health or information relating to sex life or sexual orientations of a natural person.

 Accordingly, if for any reason, and without having been requested by CONSUM, such information is communicated voluntarily by the user to the cited entity, this communication will be deemed as a declaration of express consent by the user regarding the handling of their details by CONSUM.

 

INFORMATION ABOUT THE PURPOSES OF HANDLING PERSONAL DATA AND LEGAL BASIS OF THE HANDLING

Users who access this website and voluntarily provide personal information to browse this site in a personalised manner or use any service which requires the communication of data to CONSUM, are informed of the following purposes of handling users’ personal data, what CONSMUM may do with it, and the legal basis of its handling.

In addition to the above, CONSUM informs the user that, in the cases where they participate and attend events organised by CONSUM, whatever the form of registration to them (through forms published on this site, email, or telephone), they authorise their image to be recorded in photographic or video format, and to the internal and/or external distribution of this image, in line with the provisions of the current legislation and right to information of COMSUM, statutes and/or agreements or rules that regulate the event, such as courses, workshops, competitions, meetings, and consequently, in accordance with the provisions of the current legislation regarding data protection and the Organic Law 1/1982, of 5th May, regarding the Civil Protection of the Right to Honour, to personal and family privacy and one’s own image, the user is informed that their image may be included in CONSUM publications (such as the BIS magazine) as well as in external magazines and publications (such as the ‘Entrenosotros’ magazine) aimed at member clients and on the internet in general or the website or official social networks of CONSUM.  The publication of photographs and/or recordings on the internet where the user’s image appears, entails a handling of the user’s data with a universal scope, being able to be accessed by any person from any country, including sites outside of the territory of the European Economic Area or in States who do not offer a suitable level of protection in accordance with the provisions of the current legislation regarding the protection of personal data.  In the event that he/she does not consent to said handling of data, he/she must refrain from registering and attending or participating in the referred acts and events, or if applicable, situate themselves away from the cameras or follow the instructions set out on the registration forms to object to the capturing, handling and publication of their image for the indicated purposes.

Furthermore, on this website there may be other forms and services that require the collection and handling of user data through the website, for which, CONSUM will inform users of the handling of their data.

The user must bear in mind that the personal information collected by CONSUM through the website, its forms and the different private services available, will only be used for limited purposes, such as those expressed above and/or but not limited to, those that, when applicable, will be unequivocally informed prior to the collection and handling of the data of the interested party.  In this sense, the user is made aware that the information which CONSUM publishes prior to data collection regarding the handling of data of a personal nature will take precedence over the provisions of these policies.

 In view of the handling of data expressed in the previous section, CONSUM informs the user that they intend to transfer or disclose their personal data to the following third parties as set out below.

Furthermore, CONSUM will make the user’s data available to third party data processors for the following purposes:

PERSONAL DETAILS PUBLISHED ON THE CONSUM WEBSITE

The personal details that we may publish on our website may consist of, but is not limited to, any numeric, alphabetical, graphic, photographic, acoustic (audios and videos) or any other type of information  concerning identified or identifiable natural persons, such as name, surnames, IP address, postal address and/or email address, photos, images of events organised by CONSUM and identifying information of the winners or prize winners of competitions, promotions or services organised or sponsored by CONSUM.

Similarly, personal details published on the website may include images of directors, board members, or employees of CONSUM, which will only be published for the sole purpose of making people aware of the leadership of each department of the cooperative, pictures of events organised at or by CONSUM, as well as illustrative pictures from magazine articles about CONSUM.

All of the information published on our website may only be used by users of the website for the sole purpose of finding out about the activities carried out in or by CONSUM or the activities in which CONSUM has collaborated with or taken part in, advice provided by CONSUM, opinions of CONSUM third party customers, any use other than those stipulated are expressly prohibited, including the inclusion of these images in files or data processes.

Information about participants of competitions and/or promotions is also published on this website for the sole purpose of making the name of the winning person known and to comply with the principles of publicity and transparency that rule the activities organised by CONSUM. Likewise, the names and membership card numbers may be published of those people who send CONSUM tips and/or recipes for the purpose of being published in the different media used by CONSUM, whether in conventional or electronic format.  Said information is published for the sole purpose of identifying the authors of the tips and/or recipes, and any use other than those indicated are expressly prohibited, including incorporation into other data bases or files.

In all cases, this list is included for information, but is not exhaustive and CONSUM may include other personal information on its website which will be subject to the limitations of use established in this section. 

Therefore, all personal information – including images, videos, text, data and any other information which is published on our website about identified or identifiable natural persons – may only be used by the user for the purpose of participating and enjoying our website and its services and contents in the form as established in the general conditions of use, particular conditions, this Privacy Policy and recommendations that we may write and publish, for private purposes in the applicable legal framework, for non-profit and non-commercial purposes, any use other than that specified is strictly prohibited, including the incorporation of images or information on files or processes and/or creation of databases of people and/or sending publicity or transfer to third parties, without the prior informed consent of the user who owns the information and data, CONSUM not being liable for the use by third parties of our website which contravenes the provisions of this section.

Social networks are services provided by third party providers which allow the user to take part in a virtual community with other users through which they can generate their own public profile to create and share content, information, and personal information with other users on the network.  On a social network pages, accounts or profiles can be created and shared for personal and/or commercial purposes.  The working of social networks is regulated in the first instance, by the conditions established by the owner and/or supplier of the network and in the second instance, when regarding pages, accounts or profiles with commercial ends, by the terms and conditions established by the person responsible for the commercial profile or account who, where applicable, will also be responsible for the handling of the information of these.

CONSUM has profiles on some social networks such as, but not limited to, Facebook, Twitter, YouTube and Instagram.  The user may follow us and become a fan of these official pages of CONSUM on the above social networks.

The user is informed that the handling of data through CONSUM’s pages, profiles, or accounts on social networks will be governed by the corresponding policies and conditions, both of the official page and the provider and owner of each social network as applicable, being said owner and provider of the social network who is responsible for the handling of the user’s personal information which is handled on the official page.

2 When you provide your data, which personal data do we collect?

The data that we hold for you is the data that you have given us through the client membership registration form (online or as hard copy). On this channel, the new data that we can use is what you provide us with because they are missing or incorrect on the application. This would consist of basic identification data.

3 For what (purpose) and why (legal basis) do we handle your data?

(1) To send you advertising communications: Only if you give your express consent, we will send you advertising communications relating to Consum products or activities. Remember that we are a supermarket, so you will only receive communications related to the sectors of food, consumption, etc.

Every communication you receive via email will give you the option of unsubscribing from Consum emails.

(2) To complete or correct missing or incorrect data in your application for be a member customer of the Cooperative.

4 Who do we communicate your data to?

Generally, Consum will not share your personal information. However, if administrative, tax or legal authorities, and the Law Enforcement Forces and Agencies of the State request information from us relating to your personal data, we are obliged to share this with them.

In addition, Consum has contracts with external companies (responsible for data handling) to provide us with a service related to our activity (for example, printing, marketing agencies, web developers, logistics for home delivery, etc.). These companies will have access to your data for the sole purpose of providing us with the services that we have contracted from them. We will sign a service provision contract with them, and another “Processing Order” contract, in which we will set out a prohibition on using the data to which they have access for their own ends.

With the objective of guaranteeing your privacy, we will only contract companies that provide us with sufficient security guarantees.

When communicating with you through Whatsapp, your data may leave the European Economic Area (EEA). Check the Whatsapp privacy policy, as they would be responsible should this international transfer take place.

5 How long will we keep your data?

We will keep your data while you do not request its suppression.

6 What are your rights in relation to your data?

You can exercise your right to access, correct, suppress, object its use and the right to limit its processing and to transfer your personal data. At Consum, we have set up the following mechanisms for these rights:

As personal data is the property of its owner, only you can exercise these rights. That is why we make very sure that you, or an authorised person or your legal representative are the making the request.

We are committed to protecting your privacy and your security. Consum is committed and endeavours to protect the safety of your personal data. For example, we store the personal data that you provide on limited access computer systems which are located in controlled facilities.

9 Can we update this Policy?

Occasionally, CONSUM updates this privacy policy and the processing of personal data. The date of the latest modification appears at the end of the policy.
