OBJECTIVE

The current conditions regulate access to and use of the various web portals of www.consum.es as well as the private area (partner-customer area) and all services relating to this website (from now on ‘site’ or ‘website’) under the ownership of CONSUM, S. COOP. V. with tax ID number F-46078986 and address Avenida Alginet 1, 46460 Silla (Valencia), using the same address for notification purposes. Registered in the Valencian Cooperatives Register, Central Office, with the number CV-20, also registered in the Valencian Mercantile Register in Volume 6.003, Book 3.309, Section 8ª, Sheet 1, Page number V-58.748, register 1ª, telephone +34 961974000/961974050 and contact email address atencionalcliente@coop.consum.es.

 

COMPLEMENTARY APPLICATION

These conditions are supplemented in all aspects not expressly covered by the Usage Policy, the Privacy Policy, the Legal Notice of the site, which are applicable directly and on a subsidiary basis to everything not covered or partially covered in these conditions.

The particular services regulated by these conditions are prohibited for those under 18 years of age, with the exception of certain services by TeamConsum which will be aimed at minors between the ages of 4 and 14, always under adult supervision, as established below in the description of services.

 

AVAILABILITY

The availability and type of services on this portal are subject to CONSUM’s ability to modify the form of access as well and the type of contents at any moment, without specific justification to the user nor assuming guarantees or responsibilities of any kind. Likewise, the user will be informed that particular services are offered by CONSUM “as is” without specific guarantees of results to the user and not creating for CONSUM any type of legal obligation of provision or provision of legal, consultancy or any other type of services to the user, constituting particular services in user information services.

 

INTELLECTUAL AND INDUSTRIAL PROPERTY

The user is advised that contents and services offered through the different CONSUM portals of their website, including but not limited to text, graphics, pictures, animations, music, advice, recipes, stories, comments, texts, videos, sounds, photographs, designs, comments, brands, logos, commercial names, links to other website and others are protected by intellectual and industrial property laws. Copyright and economic operation of this site lies with CONSUM and/or third-party entities who own the works.

Thus, it is the user’s obligation to respect all of CONSUM’s intellectual and industrial property rights as well as those of third parties, accessing the contents in line with the terms laid out in the usage policy and current legal regulations.

GENERAL CONDITIONS OF USE OF WI-FI IN CONSUM ESTABLISHMENTS

These conditions of use regulate the access to and use of the free Wi-Fi network services that “CONSUM, S. COOP. V” (hereinafter, CONSUM), with registered address in Silla (Valencia), at Avda./ Alginet, no. 1, VAT no. F-46078986, and registered in the Companies Registry of Valencia in Volume 6003, Book 3309, Folio 1, Section 8, Sheet No. V58748, Entry 1, provides for its customers.
The communications network is operated by Telefónica de España, S.A.U., who provides the electronic communications services and access to the Internet.

  • Object. – These general conditions are set forth to regulate the use of the Wi-Fi network, or similar technology (hereinafter, the “Service”) by customers of the establishment “CONSUM” who are physically inside CONSUM’S commercial establishments. CONSUM will provide customers who have a mobile device capable of receiving Wi-Fi signals with access to the Internet via a Wi-Fi connection.
  • Price. – Access to the “CONSUM, S. COOP. V” Wi-Fi network (or similar technology that may be implemented in the future) is free for CONSUM’S customers.
  • Limitations of use. – The Service may only be used by customers of CONSUM’S commercial establishments who are: (i) of legal age, and (ii) who are physically inside one of the commercial establishments.
    Any minors who wish to access and use the Wi-Fi services will require authorisation from their parents and/or legal guardians. By means of this document, CONSUM hereby informs the parents and/or legal guardians of minors that this service provides free, transparent access to the Internet, which permits access to content and services that may not be suitable for minors, or which may be prohibited. Parents and/or legal guardians are reminded of their responsibility to monitor and decide which contents or services are appropriate for the minors under their care.
  • Users’ obligations. –
    • Access to the Wi-Fi network or similar technology must be used diligently and correctly.
    • Use of the Wi-Fi service must be carried out diligently and correctly and must guarantee compliance with the generally accepted principles of use of the Internet. Users hereby undertake not to use the service for any unlawful, immoral activities or any that are contrary to generally accepted standards and/or for illegal, forbidden or harmful purposes or effects in regard to third parties, and not to make any other type of use of the service that could damage, disable, overload, deteriorate or impede normal use of the service, documents, files and/or any other type of content stored on any IT device accessible via the Internet, entirely exempting CONSUM from any liability that may stem from such. The service may not be used for any unlawful activities, or any that are damaging to CONSUM’S image or brand. It may not be used as a means to distribute computer virus or any other illicit activity.
    • The service is for private use only, and users may not make commercial use of this service.
  • Responsibility.- There is no relationship or association of any kind between CONSUM and any other website, or with the owners of other websites that USERS access via the Services provided by CONSUM, except for the company’s own websites. Consequently, CONSUM shall not be liable for any of the content, functions, utilities, reliability, accuracy or contents included on websites that that USERS visit. Those websites are the properties of independent companies who have no type of association or relationship with CONSUM.
    CONSUM is not responsible for any damages and/or discontinued profits that USERS or any other third parties suffer as a result of the above, nor for any faults or errors in the communications lines, or for defects or faults of the Internet.
    CONSUM is not responsible if the Internet access is slow, insecure or if it is not available at any given time.
  • Intellectual and Industrial Property. – CONSUM reserves all rights over brands, trademarks and other distinctive signs, patents and intellectual property in regard to the content and design of its Portal. All content of the portal, including, although not limited to text, graphics, images, design and intellectual property rights on such content, and any trademarks, brands and any other distinctive signs are the property of CONSUM, who reserves all rights over such. The brands, trademarks or distinctive signs are the property of CONSUM, without it being understood that downloads, access and use of the application confer any rights over the said brands, trade names and/or distinctive signs.
  • Duration and Termination. – Access to the Wi-Fi services is provided for an indefinite duration. Without prejudice to the above, CONSUM is entitled to unilaterally terminate, suspend or interrupt the said service and/or any of the other services, regardless of the provisions established in the particular conditions, without the need for prior notice.
  • Applicable legislation. – The parties, specifically waive any other jurisdiction they may be entitled to, and hereby agree to subject any conflicts stemming from the interpretation and/or execution of this contract to the Jurisdiction of the Courts and Tribunals of Valencia, which is where the obligation is to be fulfilled. In any event, Spanish law shall apply.
  • Data protection. –
    The only user data that “CONSUM S COOP V” will compile and store is the MAC address, which is the only identifier of the Wi-Fi card of the device (smartphone, tablet, etc.). The address will be stored for one year and it will then be erased.The purpose of data processing is to ensure correct management of customers’ Wi-Fi connection.The legitimate grounds for personal data processing stems from consent given by users and the acceptance of these Conditions of Use.The data will not be transferred to any third parties, unless we are legally required to.Users may exercise their data subject rights to access, rectification, cancellation and objection to processing, and the right to limited processing and data portability in the cases provided for in current legislation. To exercise the aforementioned right, data subjects should e-mail us at delegadoprotecciondatosconsum@consum.es or by post to “CONSUM S COOP V”, Avda./ Alginet, nº1, 46460 Silla (Valencia). They will need to accredit their identity by attaching a photocopy of their ID Card. Likewise, users are informed about the right to revoke their consent at any time, via the same procedure.
    Users are also entitled to file claims before the Spanish Data Protection Agency if they believe that they have been unable to properly exercise their rights.

 

EMPLOYEE PORTAL

The user can access the following voluntary services through the employee portal.

If the user is interested in finding job vacancies at CONSUM, as well as taking part in a selection process that has already begun, they must enter their academic and/or employment information as indicated on the registration form so that CONSUM can analyse their professional profile for the purposes of inviting them to participate in a CONSUM S. COOP. V selection process in view of filling vacant posts or creating new ones, as occasionally happens. The user will choose a password to be used to access the portal once registered.

The registration process will end by sending a job application. Once the application has been sent, they will receive an email to the address provided during the registration process, confirming that their application has been sent.

 

TEAMCONSUM

By accessing the site, the user can enjoy the use of different content and services that are offered by CONSUM or other third-party suppliers under the conditions laid out for each case. In general, the services and content offered through the site will be available in Spanish without prejudice to the possibility, at CONSUM’s decision, of offering the same in the other official autonomous languages, as well as other widely spoken languages. These resources are aimed at educators and families, designed to educate youngsters between the ages of 4 and 14 on healthy lifestyles and diets, and will consist of: various free access games, informative articles on food and consumption topics, competitions, group dynamics, classroom activities, notices and Team games that will be described below. This list is not exhaustive.

Team games: Users must pre-register by completing the relevant forms to access certain services on the website as well as those that users can access with a password. The website reserves the right to freely accept or reject the registration request for any user.

To make use of the Services provided on the website, minors must obtain prior parental, tutor or legal representative permission, those who would be considered responsible for all actions carried out by minors under their care. It is the full responsibility of those looking after the minors to decide which exact contents and services they can access. As the internet makes it possible for minors to access content which is not appropriate for them, we inform users that there are mechanisms, such as filtering and blocking programmes, that allow available content to be limited, and although 100% success cannot be guaranteed, these programmes are very useful for controlling and restricting material that minors might be able to access.

Within the CONSUM general policy on Corporate Social Responsibility (CSR), internal procedures of good governance have been established which, as well as being a preventative measure against criminal matters within the new criminal responsibility of legal entities, it promotes ethical behaviour amongst employees (whether worker-members or employees) and, at the same time, it ensures that both the internal regulations as well as the current legislation are complied with, and all within the cooperative’s scope of activity.

All those at whom the legislation is aimed will be able to report complaints by filling in the relevant form which can be found in the section “Complaints Channel”, placing on the record that all those who, in good faith, give information on those irregularities, will be protected against any retaliatory action, discrimination or punishment as a consequence of the complaints made.

At CONSUM, we use personal data to manage the complaints channel. Additionally, where appropriate, to prosecute or initiate the applicable disciplinary action against the person in the cooperative who has been involved in the reported acts, including a warning from CONSUM’s management to the involved person, as well as, if applicable, to enter into the appropriate legal proceedings.
