2.- RECIPIENTS

The Products offered in the Online Store are intended, solely and exclusively, for natural persons, of legal age, regarded as “consumers” or “users” in Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users and other additional legislation (“Law of Consumers and Users”). Accordingly, those who shall not be permitted to purchase the products through the Online Store include but are not limited to: children under 18 years of age, other supermarket chains, self-service stores, department stores, wholesalers, distributors, intermediaries and other professionals from the food sector.

A user shall be considered to be the person registered on the website. Once the user places an order (“order”) and completes this order, they shall acquire the status of customer.

3.- AVAILABILITY OF THE SERVICE

The offer of products on CONSUM’s online store is geographically limited. Therefore, before starting to shop, the application asks the user to select the order delivery address, stating that, if applicable, the address is not covered by CONSUM's online sales, or allowing them to continue the purchase process.

4.- FORMALISATION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF PURCHASE

The information contained in these Conditions and the details contained on this website do not in themselves constitute an offer of sale, but they are an invitation to enter into a contract. No contract shall exist until the moment that the order is expressly accepted by CONSUM. Making a purchase in the Online Store shall require the full and unreserved acceptance of the General Conditions of Purchase, in addition to the specific conditions which, if applicable, govern the acquisition, under the following terms:

The first time a registered user makes a purchase, they must mark the corresponding acceptance checkbox. The subsequent occasions on which they make a purchase, the checkbox will be displayed pre-marked, unless the GCPs have been changed, in which case notification shall be given that changes have been made to them and the registered user must mark the checkbox again to give their acceptance. CONSUM may unilaterally modify the General Conditions of Purchase at any time. Therefore, the user must read the General Conditions carefully each time they intend to access the Online Store, since they may undergo changes. The GCPs complement the Legal Notice and Conditions of Use, the Privacy Policy and the Cookies Policy, which shall be understood to be included within the General Conditions of Purchase for the relevant legal purposes.

5.- DELIVERY COSTS

For purchases costing less than sixty euros (€60), the customer must pay the fixed delivery cost of seven euros (€7), which the buyer must pay together with their shopping, in order for their order to be processed and delivered, and which includes all items relating to the preparation of the order, its handling, packing, transport and delivery. For purchases equal to or above sixty euros (€60), the customer must pay the fixed delivery cost of four euros (€4) together with their shopping.

6.- PRODUCTS AND PRICES

CONSUM offers a wide and varied range of products in its Online Store, the prices and characteristics of which shall be displayed on screen (the “product/s”). In general, CONSUM guarantees the existence of all the products it offers in the Online Store, although sometimes it may not be possible to guarantee the availability of them for all users and in the volumes required by them at the time of placing the order. In the event that, at the time of delivering the order, CONSUM does not have one of the products selected by the customer available, it shall phone the customer by telephone to offer them the option of requesting another product or, otherwise, removing this product from the order and deducting the price of it from the final order amount. To do so, the customer must have enabled the option for them to be called by telephone for this purpose on the Online Store website. CONSUM guarantees that the products supplied through the Online Store are of the highest standards of freshness and quality. CONSUM guarantees the price for the customer on the day they placed the order, regardless of the date of delivery, so that the customer is able to take advantage of all the offers available at the time of placing their orders, without prejudice to the fact that, at the time of delivery, these offers may no longer be valid. On the other hand, if the price of the products is determined by the price per kilogramme or price of the product is an estimate depending on the average weight of it, because it is purchased in units, the final price shall depend on the true weight of the product supplied. For this reason, the price of the purchase may differ from the order amount due to the existence of products of variable weight in the delivery. CONSUM informs you that there are limits to amounts and quantities with regard to purchases made in the Online Store, more specifically as follows: (i) the final amount of the purchase receipt may not, under any circumstances, exceed ten thousand euros, so there is a maximum limit of nine thousand, nine hundred and ninety nine euros per purchase receipt; (ii) a limit on units per products: there is a maximum limit of units for each product (with the same reference code) that may be purchased in the Online Store, a quantity that may vary depending on each product, and it shall not be possible to add more units of the product than the Online Store system has enabled at the time of indicating the product quantities you wish to add to the basket; and (iii) without prejudice to the above limit, there is a maximum amount limit of one thousand euros that the customer may spend on each product: in other words, it shall not be possible to spend more than one thousand euros on the same product, regardless of whether you have exceeded the limit of units purchased of that product.

Once the user has registered, the “My Details” section must be completed. The username and password are personal details and non-transferable for each user. In order to prevent third parties from gaining access to them, users shall refrain from writing down these passwords in notebooks, wallets, papers, post-it notes, etc., it is preferable that users memorise them.

If the user suspects or is certain that another person is aware of their identification details and password, they must change their password, requesting a new one in the “My user” section and clicking on “Change password”. For its part, CONSUM reserves the right to cancel the registration if it detects a fraudulent use of it. CONSUM informs you that both the collection of your data and the display of the website shall be provided through a secure, encrypted and protected connection in line with the SSL (Secure Socket Layers) protocol.

7.2.- Purchase procedure

In accordance with Article 2-Bis of Law 56/2007, of 28 December, on Measures to Promote the Information Society, regarding “Electronic invoicing in the private sector”, any user who expressly asks for an electronic invoice shall be able to access this in the "My invoices” section of the website. In this regard, the simplified electronic invoice (also known as a purchase receipt) shall be made available the day following the verification of the payment of the purchase, without the need for the customer to provide more details, simply by requesting it by clicking on the relevant box. If desired, the user may request the invoice for their purchases on behalf of a legal entity to which they are linked, entering the business name and NIF (Tax ID) of that legal entity, and other details requested.

7.4.- Payment methods

To proceed with payment, the user must follow each of the instructions displayed on screen, using one of the permitted payment methods shown in the Online Store at any time. The user shall not be permitted to pay using the “CONSUM” card. However, when payment system becomes operational in the future using this card, users shall be informed appropriately, these bases shall be modified and payment using this card shall be made operational. In all cases, the use of vouchers or discount codes may be subject to specific conditions due to their content, product they refer to, the condition of who uses it, etc., which shall in all cases be communicated to the user during the purchase process and which must be complied with fully in order to use the corresponding voucher or discount code.

If the user is a partner-customer, they may redeem their gift vouchers on their online shopping, selecting the voucher or vouchers they wish to redeem on their shopping. Charging of the purchase made shall be done at the time the simplified invoice is issued (also known as the “receipt”), in such a way that when the order leaves the dispatch centre to be delivered to the delivery address provided by the customer, it shall already be charged. If, subsequently, any incident arises in the delivery that fully or partially prevents it from taking place, the customer shall be fully or partially credited for the amounts corresponding to the product or products that it has not been possible to deliver.

7.5.- Documentary confirmation

Once the customer has finalised their purchase, they may view the verification of the transaction carried out and the order confirmation number on their computer screen. Without prejudice to the above, CONSUM shall send them proof of the transaction carried out, with all its terms, telematically to the email address provided at the time of registration, and within twenty four (24) hours from the time the customer completes the order.

8.- DELIVERY AND COLLECTION

8.1.- Geographical coverage

The online shopping service shall only be available for certain towns and/or postcodes. At the time of purchase, the customer shall have to select the delivery address, so that if a delivery address is entered for which “CONSUM” online shopping is not available, the application shall state this.

8.2.- Delivery or collection calendar

Home deliveries shall take place from Monday to Saturday, except for national, autonomous and local bank holidays, in the time slots which are available and selected by the customer at the time of placing the order. If the customer is absent from the address indicated at the time of the order delivery, the home delivery driver shall leave a note at that address stating the circumstance and the Customer Service Department number. The customer must call Customer Services to arrange another date for delivery. If CONSUM is not able to contact the customer within THREE (3) days of the date on which the delivery should have been made, CONSUM may cancel and undo the order. In this case, and in order for the order amount to be refunded, the customer must exercise their right of withdrawal, as explained in general condition 4.9 below. If CONSUM is not able to make the delivery in the time slot and/or day chosen by the customer, CONSUM shall contact the customer in order to rearrange the delivery. The default location for delivery is the entrance to the house, so the delivery driver shall not be obliged to enter the property.

9.- WITHDRAWAL

The customer may exercise their right of withdrawal under the following terms:

- Non-perishable products: the customer shall have a period of fifteen (15) calendar days from the delivery date to exercise their right. To do so, they should go to one of CONSUM's supermarkets and hand the product or products they wish to return or exchange for another of the same characteristics to the store manager, along with the purchase receipt. CONSUM offers the option of requesting the return through the “My returns” section of the Online Store for the first seven days of the full period within which they can exercise their right.

Términos y condiciones Mundo Consum

Terms and conditions Mundo Consum

1. INTRODUCTION

The terms and conditions indicated below govern the programme of exclusive advantages for "Mundo Consum" members-clients of CONSUM, S. COOP. V. (hereinafter CONSUM), with tax identification number F-46078986, and registered office at Avenida Alginet, 1, 46460 Silla (Valencia, Spain). Consumer members are linked to the programme of exclusive advantages from the moment they become members of the Cooperative.

CONSUM uses both the term "consumer member" (legal term) and "client member" (more commercial) to refer to consumer members, both in these legal texts and in the various communications with its consumer members. Both terms therefore refer to the natural person who is a consumer member and buys from the Cooperative, and is therefore referred to as a "member-client".

Belonging to Mundo Consum allows our client members to benefit from exclusive offers and discounts, both direct and personalised, depending on their tastes and shopping habits, as well as obtaining exclusive additional benefits and promotions. These actions are part of one of Consum's goals as a cooperative, which is to meet the expectations of its client members in order to provide the best response to their needs as consumers.

2. REGISTRATION

Consum is a cooperative and is made up of consumer and worker members. Our cooperative is legally described as "multi-purpose". As a consumer and user cooperative, one of our main objectives is that our client members can benefit from the best prices and products in our supermarkets. As a client member, you are a member of the Mundo Consum exclusive benefits programme, through which we make these benefits possible from a closer and more commercial perspective.

To become a member of our "Consum World" exclusive benefits programme, you must apply to become a consumer member of the Cooperative by filling in a paper form in any of our Consum establishments or in the Charter franchises participating in the programme, or through our website and our app, registering as a client member. The participating Charter establishments can be consulted on our website or by calling our client service helpline.

The application will be processed and approved by our Governing Board, the Cooperative's governing, representative and management body, within two months of the date of the application. The status of consumer member will be granted on approval by the Governing Board, but with effect from the date of application to become a member of the Cooperative. This will be accredited with a membership card which will be sent to the consumer member's home address. Registration as a consumer member entails the assumption of the rights and obligations established in the Articles of Incorporation of the Cooperative.

The compulsory share capital contribution is 10 euro cents (€0.10), which will be collected by the Cooperative by offsetting this amount against the first gift cheque issued to the member.

The request for cancellation of the loyalty programme will result in cancellation of membership of the Cooperative. The status of client member is personal and non-transferable, and the owner of the data will be solely responsible for providing their true details and for keeping them up to date so that they always reflect the real situation of the members.

The Cooperative does not permit the registration of legal entities as client members of the Cooperative.

3. OPERATING CONDITIONS AND RULES

3.1 SHOPPING BENEFITS

As a client member, discounts are automatically given for the products that the member buys regularly, which can be enjoyed thanks to the monthly delivery of a GIFT VOUCHER. The discount is generated by identifying yourself as a client member when making a purchase.

WHAT IS THE GIFT VOUCHER?

A voucher that the client member receives by post or on their mobile phone with all the discounts they have accumulated, which they can redeem on their next purchases.

The gift voucher consists of the following:

A generic part, in which there is a discount of:

1.25 % € if the monthly purchase has exceeded the amount of €125, or of

0.75 % if the monthly purchase is less than €125, but more than €50.

- Another part, also generic, in which a discount is given for each product purchased in the supermarket, which is identified with the icon "Cheque Crece".

- And a personalised part, through which, if the member agrees to the segmentation of their purchases (i.e. they have not objected), a discount is generated on the products they usually buy, called "Mis Cheque Crece".

- Members can also choose for themselves which products they would like to receive a discount on their purchases by accessing the website or the application and selecting them in the "My favourites" section.

The gift voucher has an expiry date of ONE YEAR (1) and a minimum amount of €1. If this amount is not exceeded, it is accumulated for the following month.

3.2 CARD GROUPING

It is possible to group two or more cards of family members into one card, so that all family purchases and benefits derived from the programme are accumulated in a single family unit.

Family unit.

Each family unit is made up of the client members of a family.

How do I request grouping?

- For client members, please call the client service helpline and ask for the linking form.

- For non-members, in the client membership application there is a section to apply for grouping.

4. LIVING AND TRAVELLING

The trips are exclusively for client members, but non-client consumer members may attend, providing that the person making the booking is a consumer member and they are cohabiting with the member.

The company in charge of managing the trips and therefore responsible for them, is Consultia Business Travel (registration number CV-m 1359V).

Anyone who is logged in can upload photos and comment on the trips, which will earn them points.

5. TERMINATION OR CANCELLATION AS CONSUMER MEMBER AND OF THE EXCLUSIVE BENEFITS PROGRAMME FOR CLIENT MEMBERS.

Reasons for opting out of the Cooperative:

- Voluntary: the consumer member declares their wish not to remain a member, or exercises their right to delete their personal data in accordance with the data protection regulations in force. In both cases, this is treated as a deletion of personal data, i.e. the applicant's identity is accredited, their withdrawal as a consumer member is processed and agreed by the Governing Board, their data is blocked and the interested party is informed. All this is done within a period of no more than one month.

- Cancellation because of death: proof of death is required to be provided in the form of a death certificate.

- Automatic cancellation: CONSUM can automatically terminate the membership if so much of the member's data is missing that the application cannot be considered complete (e.g. only the first name, a surname or ID card is missing); in addition, the system blocks and notifies the Governing Board for termination all those consumer members who are in the following situation (the three requirements are cumulative: a) they are over 120 years old; b) who have not subscribed voluntary share capital in the Cooperative; and c) who do not have a CONSUM payment card).

6. APPLICABLE LAW AND JURISDICTION.

These Terms and Conditions shall be governed by the Spanish legislation in force at any given time. The parties submit to the courts and tribunals of the domicile of the member or of the Cooperative, at the choice of the member, for the resolution of any disputes that may arise in relation to the corporate relationship that binds us.

  • Participate by commenting on different issues proposed on the website (such as recipes from other members or articles from Entre Nosotros magazine). They will also be able to share the contents of the website on their networks: recipes, articles, wine cellar reviews, drugstore tips, etc.

This earns points that can be exchanged for experiential gifts (only members are eligible to exchange).

They can also follow other members to receive information about what they are doing (posts, comments, etc.), because they know them personally or because they are interested in their content that they have read.

USERS WHO ARE NOT CONSUMER MEMBERS can browse the website, and by registering with their e-mail address and a password (hereinafter referred to as "non-member light registration"), they can:

  • Share their creations in the kitchen in the form of recipes and share them with the whole Community.

  • Participate by commenting on other members' recipes or sharing the contents of the website on their networks: recipes, articles, wine cellar reviews, drugstore tips, etc.

Members of the Mundo Consum Community, whether they are client members or not, earn points for the actions they carry out or the reactions to those actions by the Community, but in order to exchange them for experiential gifts, those who are not consumer members must first register as such and accept the terms and conditions of the promotion, as the advantages are exclusive to client-members.

The Community will offer a social reward based on how valuable the content generated is to others and therefore how influential it can be. This reward will be based on different medals visible on each user's profile. These medals are not redeemable for money or rewards.
