BASES OF PROMOTIONS IN THE MUNDO CONSUM COMMUNITY

 

ONE. – Purpose of the promotion.

To encourage partner-customers to participate in Mundo Consum.

 

TWO. - Company responsible for the promotion.

“CONSUM, S. COOP. V.” (hereafter CONSUM), with registered office in Silla (Valencia), Avda. Alginet, No.1 and with NIF (Tax ID): F-46078986, registered in the Register of Cooperatives of the Valencian Community, Central Office, under number CV-20, and registered in the Companies Register of Valencia, in Volume 6,003, Book 3,309, Section 8, Page I, Sheet number V-58.748, Entry 1. All communications and notifications relating to the Promotion must be addressed to this entity.

 

THREE. – Participation period.

The participation period of the promotions shall be ongoing, promotions shall remain valid on the website until CONSUM decides to remove or modify them, in such cases modifying these bases.

 

FOUR. - Legitimization to participate.

The following shall be permitted to take part in these promotions: partner-customers and other users of the website who are not partners but are registered on it (although to obtain prizes, being a partner-customer shall be an essential condition, although this shall not be necessary to take part in many of the actions).

 

FIVE. – Scope and nature.

This promotion is free of charge and shall take place in mainland Spain.

 

SIX. - Mechanics.

Firstly, partner-customers and other registered users who are not partners should access the website www.consum.es and log in. Once inside the website, they will be able to:

  • Share their cooking creations with the entire community in the form of recipes.
  • Partner-customers may take part in the “Tried and Tested” promotion where they may request free products offered on a fortnightly basis and may also share their opinions with the Community in relation to these products and share on social networks. Doing all this shall generate points.
  • If users of “Live and Travel” upload photos of trips or add comments, points will be generated.
  • Taking part by commenting on other partners’ recipes or on other website contents, sharing contents from the website on their social media: recipes, items, wine reviews, drugstore tips, etc.

With all the actions carried out by users and interactions with these actions by the rest of the community, different points will be obtained which, subsequently, partner-customers may redeem for gift experiences or donate them to various NGOs.

Those who are not registered as partners may take part in all interactions except for “Tried and Tested” and “Live&Travel” and are unable to redeem the rewards.

 

SEVEN. - Scores.

Members will achieve points for the actions they carry out or reactions to these actions by the rest of the community.

There are 2 types of action: those that refer to Participation and those referring to Recognition. The actions that contribute to recognition are those that are taken into account to obtain medals.

The list of features is provided for guidance only. The Website reserves the right to add or remove features and change the points assigned, temporarily or definitively, without the User’s consent.

Limitations 

Here at CONSUM, high quality and sustained good practices and participation in the Community are encouraged. For that reason, the points a partner receives for sharing social media content shall be limited each month, obtaining a maximum of 50 points per month. After that amount, the user may continue sharing content on social media, but they will not be rewarded for doing so.

The same occurs with Likes or ratings given or received: 1 point per Like given and 5 for Likes received, limited to a maximum of 25 points per month. In relation to rating wine, the points obtained will be 5 points with a maximum limit of 25 points per month.

With regard to points obtained for uploading recipes, this shall be limited to 50 points each week obtained from the first recipe uploaded.

Points received by a user for responses to their comments and those making the comments are also limited, with a limit of 20 points for the first comment of the month.

Points transfer 

Points may be transferred between partner-customers through the following process:

“Display Layer to enter the email of the person you wish to gift the points to and the amount. Before sending the form, checks are made to ensure the email entered is in the registered database and that there are enough points available to send, if any of these details are not checked, it shall not be possible to continue with the process. Next, the points are transferred from one account to another, notifying the recipient via email that the reward points have been received from the sender.”

 

EIGHT. - Description of the prize.

The points achieved may be redeemed for experiential rewards. The rewards available and number available shall be published monthly according to the monthly budget.

Rewards may vary, but they shall always be available on the corresponding page of the website, they shall cost less than €300 and may only be redeemed by partner-customers.

In order to redeem a reward, the partner must have the number of points stated on the website. When redeeming, they shall receive a voucher by email with the confirmation, a promotional code and the website of the provider in order to redeem the aforementioned code.

The following considerations must be taken into account in relation to the voucher:

  • Vouchers do not have a monetary value, they cannot be redeemed for cash, or sold, exchanged or replaced.
  • Vouchers have an expiry data, which shall be provided to the partner-customer at the time they receive it. Outside of the period of validity, the code may no longer be used.
  • The voucher is personal and non-transferable, only the person whose personal details are displayed on the voucher may use it.
  • The voucher may only be used once. Once the benefit to which they are entitled has been received, the voucher shall no longer be valid.

Points may also be redeemed as donations to NGOs that CONSUM has previously selected and that can be viewed on the website with the rest of the rewards.

Points shall be transferred into money, at a ratio of 100 points = €5. The amount donated by different users shall be sent monthly to the selected NGOs, mainly in the form of shopping vouchers, depending on the activity each NGO carries out.

 

NINE. - Obtaining medals.

The community shall offer a social reward based on the value of the content generated for others. This reward shall be made effective by obtaining different medals that will be visible on each user’s profile.

These medals do not equate to and may not be redeemed for money or rewards.

The conditions for achieving each medal are as follows:

 

Recipe medal

Skilled: By achieving 3 of the following actions:

  • Receiving 2 comments on 3 of your recipes.
  • Other people sharing 3 individual pieces of your recipe content.
  • Receiving 5 “likes” on 3 of your recipes

Expert: By achieving 3 of the following actions:

  • Receiving 2 comments on 9 of your recipes.
  • Other people sharing 9 individual pieces of your recipe content.
  • Receiving 5 “likes” on 9 of your recipes.

Guru: By achieving 3 of the following actions:

  • Receiving 2 comments on 15 of your recipes.
  • Other people sharing 15 individual pieces of your recipe content.
  • Receiving 5 “likes” on 15 of your recipes.

 

Wine Medal

Skilled: By achieving 3 of the following actions:

  • Receiving 5 “likes” on 5 reviews.

Expert: By achieving 3 of the following actions:

  • Receiving 5 “likes” on 15 reviews.

Guru: By achieving 3 of the following actions:

  • Receiving 5 “likes” on 30 reviews.

 

Beauty Medal

Skilled: By achieving 2 of the following actions:

  • Receiving 2 comments on 2 of your beauty contents.
  • Receiving 5 “likes” on 2 of your beauty contents.

Expert: By achieving 2 of the following actions:

  • Receiving 2 comments on 6 of your beauty contents.
  • Receiving 5 “likes” on 6 of your beauty contents.

Guru: By achieving 2 of the following actions:

  • Receiving 2 comments on 12 of your beauty contents.
  • Receiving 5 “likes” on 12 of your beauty contents.

 

Home Medal

Skilled: By achieving 2 of the following actions:

  • Receiving 2 comments on 1 of your home contents.
  • Receiving 5 “likes” on 1 of your home contents.

Expert: By achieving 2 of the following actions:

  • Receiving 2 comments on 3 of your home contents.
  • Receiving 5 “likes” on 3 of your home contents.

Guru: By achieving 2 of the following actions:

  • Receiving 2 comments on 6 of your home contents.
  • Receiving 5 “likes” on 6 of your home contents.

 

Live&Travel Medal

Skilled: By achieving 2 of the following actions:

  • Receiving 2 comments on 1 piece of content belonging to you.
  • Receiving 5 “likes” on 1 piece of content belonging to you.

Expert: By achieving 2 of the following actions

  • Receiving 2 comments on 3 pieces of content belonging to you.
  • Receiving 5 “Likes” on 3 pieces of content belonging to you.

Guru: By achieving 2 of the following actions

  • Receiving 2 comments on 6 pieces of content belonging to you.
  • Receiving 5 “Likes” on 6 pieces of content belonging to you.

 

Participation Medal

Skilled:

  • Achieving an average of 175 points per month over the last 3 months.

Expert:

  • Achieving an average of between 176 and 350 points per month over the last 3 months.

Guru:

  • Achieving an average of 351 points or more per month over the last 3 months.

 

TEN. - Prize conditions:

  • Accept these legal bases and surrender copyright of photographs.
  • It is possible to win as many prizes as can be redeemed by the points obtained.
  • In order to obtain any prize, interacting in the different actions proposed and obtaining the points needed to redeem any of them shall be imperative.
  • CONSUM does not accept liability for the use the recipient makes of the promotional gift.
  • The marketing and/or sale of the gift is prohibited.
  • Data entered during the partner-customer registration process must be accurate in order to benefit from any of the prizes, this is an essential condition.

 

ELEVEN. Deleting of comments or photographs. Cancellation of a prize or “Promotion null and void” statement.

 

The effective delivery of the prize shall be conditional upon the winner meeting the conditions specified in these bases and the veracity of the data provided when registering as a partner-customer. CONSUM reserves the right to remove all the points obtained by any participant without notice if it deems they do not meet the participation conditions, is misusing or abusing the draw, or those who commit fraudulent acts (for example, buying or exchanging likes).

Equally, CONSUM reserves the right to reject any content (i) that may be contrary to legislation, morality and public order; (ii) offensive, disruptive content or that which undermines CONSUM's image; (iii) comments that relate to advertising activity or commercial use; (iv) content that is of little interest with regard to the topics of the promotion; or (v) which is not related to a healthy cooking recipe. These entries shall not be valid and, therefore, shall not count as an entry in this promotion.

Points shall be discounted and not be assigned to the comments and images whose content may offend the reader.

Points shall be discounted and not be assigned to photographs and recipes that are not original or do not belong to the user that shares them.

In any of the cases mentioned in this point, the user may be blocked from performing any actions in the community.

CONSUM may declare the “Promotion null and void” without participants having the right to make a claim in this regard, in the following cases:

  • If it is not possible to carry out the promotion, either because of detected fraud, technical errors or any other reason that is outside of CONSUM's control and affects the normal working of it.
  • If it is not possible to locate or trace the prize winner, they decide not to accept the prize.

 

TWELVE. - Claims period.

The claims period ends FIFTEEN (15) calendar days after the date of contact with the winner.

 

THIRTEEN. - Tax status of the prizes.

In accordance with Personal Income Tax legislation, prizes awarded for participation in games, competitions, raffles or random combinations linked to the sale or promotion of goods or services are subject to withholdings or advanced payments provided that the value of the prize exceeds €300 ((Article 75-3-f) Royal Decree 439/2007, of March 30th, approving the IRPF Regulation, hereafter IRPF).

In this case, none of the prizes that can be chosen are valued above €300 and, therefore, they are exempt from IRPF withholdings or advance payments. This is without prejudice to the individual taxation that each user is obliged to pay and that they shall be responsible for. All taxes and duties related to the gifts in this promotion or additional costs caused by delays or negligence of the winner, shall be payable by them.

Acceptance of the bases of this draw automatically involves acceptance of the taxation of the prize.

 

By accepting these bases, participants surrender and transfer copyright and their corresponding rights of use over the comments and photographs published in this promotion to “CONSUM, S.COOP.V.”. The transfer is undertaken without any time limit (in other words, for an indefinite period of time), exclusively, completely free of charge and without any compensation whatsoever.

In this regard, participants acknowledge that they are the legitimate owners of the copyright that they transfer in this act, in accordance with the legislation in force, with full power to transfer it by any means.

CONSUM may use their photographs and/or comments from the publication, for any use it deems appropriate, including the publication in media other than that used for the promotion, including but not limited to physical or digital publications other than those established in the promotion.

The participant declares that the dissemination and/or reproduction of photographs does not harm o damage third parties, and expressly assumes personal and any responsibility that may result from the publication of their photographs.

 

FIFTEEN. - Sending of promotions specifically relating to this promotion:

Communications shall be sent via email to participants of this promotion to inform them of the different prizes or rewards achieved. These emails shall not contain commercial content so they will still be sent even where the user has indicated “do not send” commercial communications within the privacy preferences, since these communications refer to points that are necessary for the promotion and their legitimate basis lies in the agreement/contract, with the processing of their personal data being required for the implementation and development of the promotion.

 

SIXTEEN. - Information on data protection.

  • For what purpose do we process participants’ personal data and what is the legitimacy for the processing of their data? 
    As a participant and, if applicable, winner of any of the prizes from this promotion, their data shall be processed exclusively in order to manage it properly, in addition to handling the delivery of the prizes. In this case, the legitimization for the processing of their data is the performance of an agreement/contract, with the processing of personal data being required to execute and carry out the promotion.
  • How long do we keep their data for? 
    The personal data provided in order to take part in this promotion shall be deleted once the promotion has ended, and at the latest, in a maximum of one (1) month from that time. The data belonging to participants who are prize winners shall be kept for the period required in order to correctly handle its delivery, in addition to dealing with any issue that may arise in the use of the prizes. Given that participants surrender their copyright to the images they use to take part in the draw, in the event that people appear in these images, the personal data relating to the image shall form part of a log file belonging to Consum, and the rights recognised below may be exercised at any time.
  • Which recipients is their data passed on to? 
    Consum shall transfer their data to the Administrative authorities, Police, Public Prosecutor, Courts, where there is a legal obligation to do so, and, based on CONSUM providing a service, various data processors may access their data solely to manage and carry out this promotion, one of them being the platform, EasyPromos.
  • What are their rights when you provide us with their data? 
    The data subject may exercise their rights of access, rectification, deletion and opposition, by writing to CONSUM at the following address: Avenida Alginet No. 1, 46460 Silla (Valencia), or via email to the Data Protection Officer’s address, stating the right they wish to exercise and providing a photocopy of both sides of their DNI or legal identification document. Additionally, individuals may also exercise their rights to the limitation of processing, portability of their personal data and right not to be subject to a decision based solely on automated processing, including profiling. 
    In any case, data subjects are informed of their right to file a claim with a supervisory authority (in Spain this is the Spanish Data Protection Agency (hereafter AEPD)), in particular, when they do not feel they have received satisfaction from CONSUM in the exercising of their rights. SEVENTEEN. - Applicable legislation:

This promotion is governed by applicable Spanish legislation.

 

EIGHTEEN. - Acceptance of the bases and Jurisdiction.

Taking part in the promotion involves fully accepting these bases and expressly submitting to the interpretative decisions of the Promoter. Winners and protagonists agree to sign, if requested, a written document accepting all the terms and conditions of the promotion. All disputes arising from the application of these bases shall be resolved by the Courts of Valencia, without prejudice to the jurisdiction that may correspond to the participants by law.
